The Labour Court recommended that Tusla Child & Family Agency and IMPACT Trade Union continue national negotiations on eligibility criteria for an education welfare assessment post. The decision was dated 30 November 2017, following a worker’s appeal of an adjudication officer’s recommendation. The worker said the criteria had been changed without consultation with the union and that his training and experience supported his suitability. Tusla said the specialised role required the specified qualification. The Court noted that the worker’s appeal against the shortlisting decision had reached finality. It recommended that the parties seek to resolve the appropriate criteria through the national negotiation process, taking account of circumstances such as his.
