Labour Court sets aside recommendation for an post worker

By Donal Gilhooly

Labour Court ·

The Labour Court recommended that an post’s appeal succeed, setting aside an adjudication officer’s recommendation that a worker receive an allowance and buyout. The Court dated its recommendation 11 April 2018. The dispute concerned a local productivity allowance. An post said such allowances were normally absorbed into starting pay after promotion, while accepting that the allowance had been paid inconsistently. The worker was a member of CWU, which had accepted an earlier collective recommendation with an post providing a buyout for 11 managers as full and final settlement of claims over ending the allowance. The Court said it normally upholds collective agreements and relied on the full and final settlement in the earlier recommendation when it set aside the adjudication officer’s recommendation.
