The Labour Court ruled that Kildare West Wicklow Community Addiction Services CLG’s appeal over Stephen Kelly’s €3,250 award was out of time and that it had no jurisdiction to hear it. The decision was dated 8 August 2017. The Court received the appeal on 19 June 2017, after the 42-day deadline. The employer said it expected registered post to arrive in time, misunderstood the deadline and was affected by its manager’s sick leave. Kelly, represented by Unite, opposed an extension. The Court found those circumstances did not justify the delay; the merits were not decided.
