Labour Court overturns Fado Restaurant ruling and awards waiter €650

Labour Court ·

The Labour Court overturned a Rights Commissioner’s decision in Jose Izquierdo’s minimum wage appeal and awarded him €650 in arrears. The determination was signed on 30 August 2004. Izquierdo had claimed €1,314, saying unpaid hours reduced his average hourly rate. Mansion House Limited, trading as Fado Restaurant, said he had been paid €6.35 for all hours worked. The Court found the employer had not kept adequate records to prove compliance with the National Minimum Wage Act, 2000, and had failed to prove it complied with the Act. It considered the amount claimed overstated and assessed the arrears at €650.
