The Labour Court upheld a €1,900 wage-arrears award to Piotr Kalkowski, rejecting an appeal by his employer, Marc O’Mahony trading as The Good Food Shop, formerly trading as Premier Organics. The determination was dated 23 February 2010. Kalkowski said he often worked more than 40 hours a week for €250, leaving his hourly rate at about €5. O’Mahony said he averaged 40 hours and received lodgings and transport. The Court found the employer had not provided records to prove compliance with the National Minimum Wage Act. Lodgings counted towards the wage calculation at €21.85 a week, but transport did not.
