Labour Court overturns decision and awards truck driver €15,180.75 in wage arrears

Labour Court ·

The Labour Court set aside a Rights Commissioner’s decision and directed O’Leary International Ltd to pay truck driver Viktors Gurkovs €15,180.75 in national minimum wage arrears. The determination was signed on 3 March 2014.

Gurkovs worked from the company’s premises in New Ross, Co Wexford, and received €60.55 a day, or €302.75 a week, plus a separate daily allowance. The Court found his contractual hours were 48 a week for minimum-wage calculations. It said tachograph records did not reliably show all working time, which could include official travel and overnight periods when he could be required to work. The Court found he had not received the minimum wage and was entitled to arrears.
