Labour Court rules Quick Service Rest System appeal was not properly before it

Labour Court ·

The Labour Court ruled that Quick Service Rest System Limited’s appeal over three complaints brought by Vitali Saveljev was not properly before it. The determination was signed on 22 February 2018. An adjudication officer had held the complaints under employment information, minimum wage and wages laws well founded. The company argued that Serghei Groppa, trading as Humdinger’s, who had been named as the respondent, was not the complainant’s employer and that the company was. The Court found that the company had no standing to maintain the appeal and that it had no statutory jurisdiction to substitute one party for another. The complaints were not reconsidered in this appeal.
