The Labour Court has affirmed a finding that Zhihua Yuan’s complaint against Gaffney Mechanical Limited was not well founded under the Protected Disclosures Act 2014. The decision is dated 30 September 2026.
Yuan alleged the company contravened the Act after he made a protected disclosure to the WRC. He relied on a contract and employment permit naming Gaffney Mechanical as his employer, and said it was responsible for his work for another entity. The company said it had not employed him after he arrived in Ireland. The Court found he had not established an employment relationship with Gaffney Mechanical during the relevant period or a legal relationship between it and the other entity. It found the complaint not well founded and affirmed the Adjudication Officer’s decision.
