The Labour Court disallowed the union’s appeals and allowed Tedcastle Aviation Fuels Ltd’s cross-appeals in three claims under the Protection of Employees (Part-Time Work) Act 2001 by William Fitzgerald, Sean Kelly and Patrick Hehir. The determination was signed on 17 September 2013. The union conceded that its original claims could not succeed because information had become available after the Rights Commissioner decisions. The Court therefore disallowed the union’s appeals and allowed the company’s appeals.
