The Labour Court overturned a €74.48 award to Andrew Allen after upholding Britvic Ireland Limited, trading as Britvic Ireland’s appeal over a deduction from his December 2014 wages. The determination was dated 14 December 2015.
Allen and the company both appealed the Rights Commissioner’s decision. Allen said the company usually paid staff for the full break-up day after they completed their work. The company said he left without permission and did not complete additional work. The Court found full-day pay depended on completing assigned work and getting permission before leaving. It held no unlawful deduction was made, upheld the company’s appeal and rejected Allen’s appeal.
