The Labour Court partly allowed Pawel Zadruzny’s appeal against G4S Secure Solutions (Ireland) Ltd, awarding him €350 for roster notice failures and increasing his late annual-leave payment award from €100 to €200. In its determination dated 24 July 2017, it also ordered G4S to pay the balance of his sick pay for 2013 and 2014, without stating a figure.
The Court found that four claims under the MUT agreement were not well founded because Zadruzny was not a SIPTU member covered by it. His complaint about refused annual leave also failed: the Court found no evidence that G4S had overlooked his family responsibilities or need for rest and recreation.
The Court found his penalisation complaint was not well founded, noting that he received his hours entitlement and any shortfalls were made good. It upheld his complaint that G4S had not given 24 hours’ notice of roster changes and found he was entitled to payment in advance for annual leave.
