The Labour Court upheld the decision that Gerard Huban’s complaint over an alleged €22,638 wage deduction was outside the statutory time limit. The Court’s determination was dated 10 October 2023. Huban appealed after the WRC adjudication officer ruled that the complaint was out of time and lacked jurisdiction to hear it. He argued that the time limit should be extended because he waited for confirmation of his employee status. The Court found the alleged deduction occurred in December 2017, outside the relevant period, and said it had no power to vary the statutory time limits. The appeal was not allowed; the merits were not decided.
