Labour Court directs Mythen Brothers to follow construction agreement dispute process

Labour Court ·

The Labour Court directed Mythen Brothers Ltd to comply with clause 11 of the construction industry agreement after finding the company had refused to take a union dispute through the agreement’s resolution process. The decision was signed on 14 December 2005. Building and Allied Trades Union said the company treated two bricklayers, Hugh Christie and John Christie, as subcontractors and refused to follow the agreement’s procedure. Mythen Brothers disputed that the men were its employees. The Court found they were workers covered by the agreement and that the company had breached the dispute procedure. A separate complaint about subcontractor criteria did not arise for adjudication.
