Labour Court overturns redundancy decision after finding Helen Greene’s job transferred

By Aoife Loughran

Labour Court ·

The Labour Court overturned a decision awarding Helen Greene statutory redundancy pay after finding that her employment transferred with the Jerpoint Inn business. The determination was dated 13 October 2017. Greene had worked as a bar worker at the Thomastown pub since 2002 and continued in the same role after Brian Cahill T/A Jerpoint Inn transferred the business in July 2016. The Court found that the business retained its identity and that Greene’s continuous service transferred to the new owners by law, so she was not entitled to redundancy pay. It also rejected Cahill’s argument that her complaint was late, finding it was made within the applicable 52-week limit.
