Labour Court upholds €1,500 award on Knockmaroon Estates appeal

Labour Court ·

The Labour Court upheld a €1,500 award to Radu Labionschi after Knockmaroon Estates Company appealed a finding that it failed to provide him with written employment terms.

The determination was dated 8 July 2016. Labionschi worked as a caretaker from 1 January 2010 until 17 October 2014, was paid €407.22 a week and received accommodation on the estate.

Labionschi said he had not received a written statement of his terms. The company acknowledged the breach but argued he knew his terms, suffered no prejudice and that the award was excessive.

The Court found the company had infringed his rights under section 3 of the Terms of Employment (Information) Act 1994. It considered the company’s arguments and upheld the Rights Commissioner’s decision, leaving the €1,500 award in place.
