The Labour Court upheld a €1,200 award to Andreea Labionschi after Knockmaroon Estates Company appealed a finding that it failed to provide her with written employment terms.
The Court’s determination was signed on 8 July 2016. Labionschi worked as a housekeeper and later a cook from 1 January 2010 until 17 October 2014. She was paid €350 a week and provided with accommodation on the estate.
Labionschi said she had never received a written statement of her terms and conditions. The company admitted it had not provided one, but argued that she knew her terms, suffered no prejudice and that the award was excessive.
The Court found the company had infringed her rights under section 3 of the Terms of Employment (Information) Act 1994. It considered the company’s arguments and found the Rights Commissioner’s decision fair and reasonable, leaving the €1,200 award in place.
