The Labour Court disallowed Hussain Ali’s appeal and affirmed the rejection of his unfair dismissal complaint against Kohinoor Limited. The determination was signed on 1 November 2016. Ali argued his redundancy was a sham and that the company selected him because of an ongoing dispute. Kohinoor said falling business needs required it to reduce the number of chefs and that it used a selection matrix. The Court found there was a genuine redundancy, Ali was consulted and given a chance to comment on his scores and appeal, and the selection criteria were objective and fair. It concluded that he was not unfairly selected for redundancy.
