The Labour Court increased Aneta Petrova’s unfair dismissal compensation from €12,000 to €17,000 after Western Brand Group Limited appealed. The Court dated its determination 5 April 2018.
The Court found Western Brand Group Limited knew Ms Petrova’s illness was related to her pregnancy and miscarriage when it dismissed her for absence. It concluded that pregnancy-related illness was the operative reason for the dismissal, which was unfair.
In setting compensation, the Court noted that Ms Petrova had not found work since her dismissal and had been medically unfit for her job for a period. Her average weekly earnings were €310. The Court also took account of limited evidence about her efforts to find work and her unavailability after dismissal.
