The Labour Court ruled that Aztec Entertainment Ltd’s appeal against a €35,000 unfair-dismissal award to Bernard Robinson was outside the time limit and the Court had no jurisdiction to hear it. The determination was signed on 9 June 2021; the merits of the appeal were not decided. Aztec argued that a public holiday affected the deadline and that exceptional circumstances justified the late appeal. The Court found the 42-day period included public holidays and that the solicitor’s failure to email the appeal did not show circumstances that prevented it being filed in time.
