The Labour Court rejected Marek Bartosik’s appeal and affirmed the decision that his constructive dismissal complaint against Citi Bus Ltd was not well founded. The determination was dated 9 June 2023. Bartosik said concerns about his work and conditions left him with no option but to resign. Citi Bus denied dismissing him and said it had engaged with his concerns. The Court noted that the parties discussed his concerns at a return-to-work meeting and that Bartosik later objected to a duty involving the bus toilet. It found the company’s conduct did not justify his resignation and noted that he chose not to attend a further meeting before resigning. The Court found his employment did not end by constructive dismissal.
