The Workplace Relations Commission found it had no jurisdiction to hear Somy Thomas’s unfair dismissal complaint because the claim named the Health Service Executive Hse rather than her former employer, Beaumont Hospital. The decision was dated 21 May 2024. Thomas said she had been constructively dismissed from her staff nurse job and asked the WRC to substitute Beaumont Hospital as respondent. The hospital objected, arguing it was a different legal entity and that the request came years after the complaint. The adjudication officer found Thomas had sought to replace the employer, not correct a mistaken name, and declined to make the substitution. The merits of the unfair dismissal complaint were not decided.
WRC could not hear Somy Thomas’s unfair dismissal complaint against HSE
