The Workplace Relations Commission dismissed Ion Tataru’s unfair dismissal complaint against Northway Personnel Limited, finding the agency was not the correct respondent. The decision was dated 21 June 2023. Tataru said he worked night shifts cleaning data centres under construction and alleged he had not been paid for hours worked or annual leave. He also said he was dismissed, called back and later placed on lay-off. The agency denied the claims and said staff were laid off during a lull in the project. The WRC found that Tataru had received a statement of employment terms, so that complaint was not well-founded. It also found no evidence of a breach of working-time rules in the six months before he lodged the complaint in May 2020. That complaint was also not well-founded.
