The Workplace Relations Commission (WRC) ordered JBK Auto DAC trading as Kel Auto Solutions Ltd to pay Yuriy Kapustyanyk €2,101.96 after finding the company had not provided required employment terms. The decision was dated 30 May 2023. Kapustyanyk said he had not received employment terms in a language he understood or in English, while the company said he had received a contract. The WRC upheld the complaint that terms and conditions had not been provided and set the award at four weeks’ wages. It treated a separate statement-of-terms complaint as encompassed by that finding. The WRC rejected his complaints about annual leave, notice pay, a change to his contract, unfair dismissal, discrimination, redundancy and notice rights. It found the layoff followed the government lockdown instruction and did not amount to unfair dismissal. A public-holiday complaint was outside the time limit, so its merits were not decided.
