The Workplace Relations Commission found that a change of security contractor at the Jameson site was not a transfer of an undertaking, rejecting Peter Freeman’s complaint against Nightsafe Security Service Limited t/a Active Security Management. The decision, dated 14 July 2023, said the incoming contractor used its own staff and no assets transferred. Freeman had argued he should have been taken on at the site after working there as a security guard for about 20 years. The WRC found the change did not transfer an organised economic entity retaining its identity, as required by the regulations.
