Richmond Marketing ordered to pay Jonathan Foy €10,000 for unfair dismissal

By Cathal Brosnan

Workplace Relations Commission ·

The Workplace Relations Commission awarded Jonathan Foy €10,000 in compensation after finding that Richmond Marketing unfairly dismissed him. In a decision dated 20 June 2023, it also ordered the company to pay €1,187.50 in notice pay and €84 in unpaid wages.

Foy, who worked as an account developer visiting stores, said his August 2021 dismissal was unreasonable and arose from a personal grudge. Richmond Marketing said it dismissed him over concerns about his whereabouts, trust and confidence, and an existing final written warning.

The adjudicator found flaws in the disciplinary process and said the company had not shown that Foy failed to attend the Rathmines store. He found Foy did not contribute to his dismissal and had tried to reduce his financial loss. The WRC also upheld his notice-pay and unpaid-wages complaints, while rejecting his two mobile-worker complaints and two Employment Equality Act complaints. In plain terms, the mobile-worker rules did not cover his work driving a car, and he had not identified a discriminatory ground.
