The Workplace Relations Commission found that Ruzain Reza had not established disability discrimination by MCR Outsourcing Limited. The decision was dated 20 June 2023. Reza said he was dismissed because of his asthma and after raising compliance issues. The company denied discrimination and said performance concerns led to his dismissal. The adjudication officer found the company knew of Reza’s disability and that his dismissal was unfair, but said there was insufficient evidence linking his asthma to the dismissal. The officer also found that requiring Covid tests was not discriminatory.
