WRC awards €10,000 in mattress retailer pay and commission complaint

By Eimear Byrne

Workplace Relations Commission ·

The Workplace Relations Commission (WRC) has found a pay and commission complaint against Somnus Gsm Limited Mattress Mick well founded and directed the company to pay Shane Hearne €10,000. The decision was dated 25 May 2023.

Hearne said his agreement included net pay of €550 a week and commission of 2% of merchandise sales. He claimed €14,826.16 remained due after payments received. The company said managers earned commission on personal and overall store sales at different rates, net of VAT.

The adjudication officer found no written evidence establishing the commission arrangement and said the employer should have set out the terms in a signed contract. He also noted that Hearne, as managing director, had responsibility to ensure the pay and commission terms were documented. The Payment of Wages Act complaint was found well founded.
