The Workplace Relations Commission found Rafał Terlecki’s claims for annual leave and public holiday pay against PHTS Limited t/a Patrick Horgan Tyre Services not well founded. The decision was dated 3 August 2023. Terlecki sought leave and holiday pay for a period when he was out sick. He had submitted medical certificates for his first three weeks away, but accepted that he had not given his employer further certificates during the remainder of his employment. The adjudication officer found that later period was uncertified and that a subsequent GP note did not meet the statutory certification requirement. The officer found no annual leave payment was due for the relevant claim period, which fell during uncertified absence, and that Terlecki was not entitled to public holiday pay during the relevant six-month period.
