The Workplace Relations Commission had no jurisdiction to hear Aisling Murphy’s unfair dismissal claim against Madigan's Pharmacy Kilkenny Limited, so the merits were not decided. In a decision dated 27 June 2023, it found that messages she sent about claims for dispensing fees under the Long-Term Illness scheme were protected disclosures. Murphy had worked for the pharmacy for less than a year. The WRC accepted that the pharmacy had concerns about her performance and had secured a replacement before she sent the messages. It found she had not shown that her dismissal resulted wholly or mainly from the disclosures, and concluded it could not hear the substantive claim or award redress.
