WRC rejects disability discrimination claims by former Irish Shared Administration Centre worker

By Ruairí Dolan

Workplace Relations Commission ·

The Workplace Relations Commission rejected Seán Hussey’s claims against Irish Shared Administration Centre Ltd, finding he had not established discrimination, a failure to provide reasonable accommodation, discriminatory dismissal or victimisation. The decision was dated 27 June 2023.

Hussey said isolation while working from home, insufficient work and the employer’s response to his concerns led him to resign. The company said business and available work fell during the pandemic and it assigned the additional work available.

The adjudicator found the company knew of health issues amounting to a disability from 11 March 2021, but said Hussey had not established facts that raised an inference of discrimination. The WRC also found the company provided the accommodation sought and that Hussey was not discriminatorily dismissed or victimised for raising an equality issue.
