The Workplace Relations Commission found David Geoghegan’s unfair dismissal complaint against Fannin Ltd T/A Fannin Dcc Vital was not well founded in a decision dated 2 August 2023. Geoghegan said recording errors were clerical mistakes linked to Covid-era working conditions and challenged the fairness of the investigation and appeal. The company said it dismissed him for gross misconduct after finding he had recorded service calls as complete without doing the work. The adjudication officer found that Geoghegan marked unfinished jobs as complete and received payment for them. She concluded that the employer acted reasonably in dismissing him, given the evidence and the safety-critical nature of the work. The officer found the dismissal both procedurally and substantively fair.
