The Workplace Relations Commission found Christy O’Toole’s complaint of discriminatory dismissal against Enfer Labs ULC misconceived and not well founded; the merits were not decided. O’Toole was employed and paid by an employment agency and placed with Enfer Labs from 31 January to 10 February 2022. The WRC said the agency, which paid his wages, was his employer for the purposes of the Employment Equality Act. It found Enfer Labs had not dismissed him: his placement ended after the company stopped using agency workers. The complaint was misconceived because he named the end user rather than his employer as respondent. The decision was dated 2 August 2023.
