The Workplace Relations Commission found Philip White’s age-discrimination and constructive-dismissal complaints against Noons Transport Ltd. unsuccessful in a decision dated 15 June 2023. White said he took temporary holiday-cover work after being told Noons had no work for him, then believed he had been replaced when he saw his usual truck back on the road. He alleged age discrimination over a lack of training on air-pressure trailers. The company said it understood he was leaving permanently for longer-term work and had no full-time work available. The adjudicator accepted the respondent’s account on the competing evidence and found the conduct did not meet the test for constructive dismissal. The discrimination complaint also failed because the evidence was insufficient to establish discrimination.
