The Workplace Relations Commission ordered B & G Barista Limited D18 Restaurant (Formerly Trading as Barista Café) to pay Adam Truszkowski €13,615 in statutory redundancy pay, finding his redundancy complaint well founded. The decision was dated 31 May 2023. Truszkowski worked for the business as a café manager until November 2021. He said he had been kept from returning to his former role and that the company changed his working hours and conditions. The company said it offered him work after reopening, but he declined because of childcare difficulties. The WRC accepted that Truszkowski had delivered an RP9 form notifying the company of his intention to claim redundancy pay. The company did not complete and return its part of the form within seven days, as required. The adjudicator ordered the redundancy payment to be made within 42 days. The unfair-dismissal complaint was not well founded and failed. The WRC also found the working-time complaint well founded, ordering the company to calculate and pay outstanding holiday and public-holiday entitlements. The decision did not set out the amount of that payment.
