Landlord ordered to pay €3,000 after WRC finds HAP discrimination

By Eimear Byrne

Workplace Relations Commission ·

The Workplace Relations Commission (WRC) found that a landlord discriminated against Karen Duffy after withdrawing a tenancy offer when she said she would use the Housing Assistance Payment (HAP) scheme. It ordered the landlord to pay €3,000 compensation.

The WRC decision was dated 23 May 2023. Duffy had sent the landlord HAP forms after viewing a property in Balbriggan. The landlord did not attend the hearing, and the WRC considered Duffy’s evidence unchallenged.

The WRC extended the time limits after finding Duffy had reasonably relied on incorrect advice from a housing NGO. It found the withdrawal of the offer because she would use HAP amounted to prohibited conduct under the Equal Status Acts. The compensation was for the effects of that discrimination.
