The Workplace Relations Commission found that Gheorghe Daniel Marcu was not unfairly dismissed by Dangan Group. In a decision dated 31 May 2023, it said it was not satisfied that his employment had been terminated. Marcu said he believed his employment had ended after he was not offered a return to work and later took another job. Dangan Group said he remained on long-term layoff after refusing duties and alternative work, and that it had offered him positions. The WRC found no evidence that Marcu had been dismissed and said his move to another employer did not amount to a dismissal under the Unfair Dismissals Act. It therefore found that he was not unfairly dismissed.
