The Workplace Relations Commission found Rachel Dunne’s disability discrimination complaint against Ewn Retail Limited, T/a Roches Spar not well founded. The decision, dated 3 July 2023, concerned her request to leave work early while unwell on 5 March 2022. Dunne said she was asked to stay until 1pm and that her condition worsened before she got home. The employer denied discrimination and said she had not established facts from which it could be inferred. The adjudicator preferred the director’s account and found Dunne had not established that she connected her symptoms to her disability that day or was treated differently because of it.
