The Workplace Relations Commission found four complaints by Linda O'Regan against the Health Service Executive( HSE South) not well founded, finding she had held a contract of indefinite duration since 14 May 2004. The decision was dated 3 July 2023. O'Regan argued that she remained a temporary worker and sought a permanent appointment as a Multitask Attendant Grade 3. The HSE said she was already permanent by operation of law. The adjudicator found she did not have standing to bring claims under the Protection of Employees (Fixed-Term Work) Act, 2003; the arguments about time limits and the substance of her claims were moot. The adjudicator encouraged the parties to resume discussions on a return-to-work date.
