The Workplace Relations Commission found that Margaret Irving’s constructive-dismissal and minimum-notice complaints against NetSpeed Ltd were unsuccessful in a decision dated 15 June 2023. Irving said she resigned after learning that a new Finance Manager would be appointed above her without giving her a chance to apply. She said she had handled most finance duties for more than 12 years and felt undermined. The company acknowledged that it had handled the appointment poorly, but said it valued her and hoped she would work with the new manager. The adjudicator found that the communication was poor but not so unreasonable that it justified her resignation. As constructive dismissal was not established, the minimum-notice complaint also failed.
