The Workplace Relations Commission ordered ISM Recruitment to pay George Evans €4,336.07 in outstanding wages after finding his agency pay-parity complaint partly well founded. The decision was dated 26 May 2023. Evans said directly employed Roadstone drivers received better pay and conditions than agency drivers, including allowances, a bonus and paid training. ISM said it had sought information and back pay from Roadstone, and argued that the hirer was responsible for the delay. The adjudicator found there was insufficient evidence for the other elements of Evans’s claim, so those were not well founded. But ISM remained responsible for the outstanding wages after Roadstone’s pay increases were not applied to its drivers. Agency workers are entitled to the same basic working conditions as comparable employees of the hirer.
