The Workplace Relations Commission awarded bookkeeping worker Godwin Ndemera €2,402 in compensation after finding his unpaid wages complaint well-founded. The decision was dated 20 June 2023. Ndemera said he had not been paid for work completed in June 2022. His employer, Elite Accounts & Tax Services Limited, argued that he was a subcontractor rather than an employee and sought an adjournment. The respondent did not attend the hearing, which went ahead in its absence. The WRC found that Ndemera worked under a contract of employment, based on the work assigned to him, his integration into the firm and the employer’s direction and review of his work. It found an unauthorised deduction of €2,402 from his wages and ordered compensation in that amount, subject to usual income deductions.
