The Workplace Relations Commission found that Tom Cunningham lacked the required service to pursue an unfair dismissal claim against the Health Service Executive. The decision, dated 17 July 2023, said he had less than 12 months’ service when his employment ended, so the WRC had no jurisdiction to hear the complaint; the merits were not decided. Cunningham argued that problems with reviews, training and the dismissal process made his dismissal unfair. The HSE said he had less than a year’s service, was on probation and had not met the expected work standard.
