The Workplace Relations Commission found a childcare worker’s constructive dismissal complaint and a complaint about her employment terms were not well founded. The decision was dated 10 May 2024. The worker resigned after her child twice left areas where he was being cared for at the creche where she also worked. She said the incidents and the creche’s handling of her concerns undermined her trust in the employer. The creche said the concerns related to childcare services rather than her employment, and that it investigated, introduced safety measures and offered further meetings and alternative childcare. The adjudication officer found the worker had not established a breach of her employment contract or unreasonable conduct relating to it, and had not used the employment grievance procedure before resigning. The officer also found she had received a contract of employment when she started work.
