The Workplace Relations Commission found that Michelle Cunningham was not unfairly dismissed by Pebble Beach Playschool, ruling that her job ended through redundancy. The decision was dated 4 July 2023. Cunningham said she was asked to consider a pay cut before being told that redundancy was the alternative. The playschool said financial difficulties and the need to reduce staffing led to the redundancy. Under the Unfair Dismissals Act, a dismissal by way of redundancy is deemed not to be unfair.
