The Workplace Relations Commission found Gary Casey’s constructive dismissal complaint against Keenan Timber Frames Ltd As Above was not well founded. The decision was dated 18 May 2023. Casey alleged repeated bullying by another employee and said he resigned after an incident at work. The company denied constructive dismissal and said he had not used its grievance procedure before resigning. The adjudicator found Casey knew about the grievance procedure but chose not to use it. The company therefore had no opportunity to address his concerns, and the adjudicator considered his resignation premature and unreasonable.
