The Workplace Relations Commission said it lacked jurisdiction to hear Loui Osman’s unfair dismissal complaint against Fyffes Tropical Ireland Ltd because it was referred outside the six-month time limit. The decision, dated 27 July 2023, says the merits were not decided. Osman worked as an IT Analyst and was dismissed on misconduct grounds. He said the investigation and disciplinary process were deficient and that he lacked structured support. Fyffes cited earlier warnings and said it had followed fair procedures and allowed him to appeal each disciplinary sanction. The WRC found the complaint was referred after the six-month deadline and found no justifiable excuse for the delay. It therefore found the complaint was brought outside the time limit and was not well founded; the merits were not decided.
