The Workplace Relations Commission ordered TransEuro to pay truck driver Johannes Lodewikus Lee €6,973 for unauthorised wage deductions and €750 for underpaid annual leave. The decision was dated 28 July 2023. Lee said his pay fell short of the €750 weekly gross salary in his employment offer. TransEuro argued that the work-permit figure included subsistence expenses. The adjudication officer found expenses were not wages and that Lee had not agreed to a salary change. A gross pay shortfall was identified in 25 of the 26 weeks before his complaint. The annual-leave award concerned leave remaining when his employment ended. The WRC found Lee’s night-work complaint not well founded. It found his terms-of-employment complaint was brought outside the time limit and was not well founded; the merits were not decided. His race discrimination, harassment and victimisation complaint was not well founded. Four other complaints were withdrawn.
