The Workplace Relations Commission found Valentin Arghiropol was not unfairly dismissed by Michael Dixon International Transport Limited t/a Dixon Transport. The decision, dated 8 June 2023, also found the company had not contravened the minimum notice law. Arghiropol said he considered himself dismissed after returning from leave in Romania and being told there was no work for him at that time. The company said he had resigned by taking unpaid leave despite knowing it would break his domestic driver contract. The adjudicator found he understood that his employment would end if he went to Romania to collect his car, and had knowingly left his position. Because there was no dismissal, he was not entitled to minimum notice.
