The Workplace Relations Commission found that Paul Hannaway’s complaints against Kilsaran Concrete Unlimited Company were not well founded. The decision, dated 20 May 2024, concerned constructive dismissal and alleged workplace-safety penalisation. Hannaway resigned in August 2022 after raising workplace concerns, including about truck weights, and following an incident in which a customer assaulted him and threatened his wife. Kilsaran said its manager directed staff to load the customer’s vehicle to get him off the premises, and the company later banned him from its businesses. The adjudicator found that earlier issues had been resolved or could have been raised through the grievance process. While acknowledging Hannaway’s upset about the customer incident, the adjudicator found that the employer’s actions did not make his resignation justified. Both complaints were found not well founded.
