The Workplace Relations Commission (WRC) upheld Grzegorz Wasilewski’s unfair-dismissal complaint against Rcps Property Services Ltd and awarded him €750. The decision was dated 1 August 2023. The adjudication officer found that the dismissal was unfair because Wasilewski was not given a fair procedure or a chance to explain his actions. Wasilewski and a colleague had been changing locks at a property in Arklow. The company said they returned to the property against instructions and treated this as gross misconduct. Wasilewski said they went back to use the toilet and photograph the locks, and that he was not allowed to explain himself before being dismissed. The officer found Wasilewski knew returning to the property was impermissible and had made a very substantial contribution to the situation. He also took account of Wasilewski finding work relatively quickly at a lower wage, and reduced the compensation accordingly.
